The following outlines our policies and procedures specific to our services and serves as a service agreement between you (“THE CUSTOMER”) and OUTERLINED CONTRACTOR LLC (MyHomeImproved.com).
Scope of Work
OUTERLINED CONTRACTOR LLC will perform at the CUSTOMER address listed above in accordance with the detailed scope of work attached to the estimate e-signed and approved by COSTUMER.
Change Orders
OUTERLINED CONTRACTOR LLC will perform only those services approved in writing or e-signed by the CUSTOMER. If the CUSTOMER shall, at any time, require services not listed in the scope of work attached, a written change order shall be created and signed by both parties prior to the performance of such work.
Permits, Licensing, & Approvals
Insurance & Loss Coverage
The CUSTOMER agrees to maintain adequate property insurance to protect against loss or damage due to theft, fire, vandalism, etc.
OUTERLINED CONTRACTOR LLC agrees to maintain reasonable liability insurance to protect against personal injury or loss.
Both parties agree to provide copies of the insurance certificates for their respective policies to one another.
Property Access
The CUSTOMER agrees to be present at the scheduled work time to ensure that personal of OUTERLINED CONTRACTOR LLC has reasonable access to the working area, including parking space.
OUTERLINED CONTRACTOR LLC agrees to contact CUSTOMER 48 hours prior to arrival to schedule an appropriate arrival time, and agrees to make a reasonable effort not to disturb or damage the CUSTOMER property outside of any demolition required for the project listed in the scope of work
Punctuality / Rescheduling & Cancellation Policy
In order to accommodate our customers with work completed in a timely manner, punctuality is critical. Our servicemen will arrive at your house within a 30 minute time frame. If for any reason we are unable to honor our scheduled appointment, you will be notified as soon as possible, and your appointment will be rescheduled to the next available time.
If you incur a scheduling conflict, appointments may be rescheduled with a minimum notice of 24-hours. Last-minute cancellations or homeowner-neglected appointments will incur a minimum charge of $15.
Site Conditions
The scope of work and pricing for this contract are based on conversations and any walkthroughs completed by OUTERLINED CONTRACTOR LLC and the CUSTOMER. OUTERLINED CONTRACTOR LLC has taken reasonable measures to ensure that the scope of work and pricing represent the entire project requirements, but cannot guarantee a final price due to the possibility of unforeseen complication.
In the event that unforeseen complications, including (but not limited to) mold, termites, structural damage, or building code violations are discovered after the project begins, OUTERLINED CONTRACTOR LLC, will cease work on the project and draft a change order listing any additionally required materials or labor. Homeowner agrees that any unforeseen complications may increase the final price of the project.
OUTERLINED CONTRACTOR LLC, will do its best to remove construction debris. Our servicemen will take everything that fits in a garbage bag and will neatly pile any larger pieces on your property per your direction. Removal of debris is usually included in scope of work, but if it is not, any removal of debris from the premises will be the sole responsibility of the customer. But, we will be happy to refer you to one of our hauling subcontractors.
Payment Terms
1.2. OUTERLINED CONTRACTOR LLC shall not be binded to CUSTOMER payment terms, unless otherwise agreed by OUTERLINED CONTRACTOR LLC and the CUSTOMER in a dated written and signed document format.
4. The CUSTOMER shall under no circumstances be entitled to withhold payment, for any reason whatsoever. Withholding of payment shall be deemed to be a material breach of the agreement which would entitle OUTERLINED CONTRACTOR LLC the remedies set out in clause Cancellation Policy.
5. OUTERLINED CONTRACTOR LLC shall be entitled to invoice each delivery or performance separately when executed.
6. The CUSTOMER shall pay to OUTERLINED CONTRACTOR LLC the full amount as stipulated in the invoice within a maximum period of five (5) days on receipt of invoice.
6.1. OUTERLINED CONTRACTOR LLC will be charged a 10% interest on outstanding amounts not paid within seven (7) days of date of invoice every seven (7) days or part thereof until handed over to debt collecting agent or paid in full.
7. The CUSTOMER agrees that if an account is not settled in full (a) against order; or (b) within the period agreed in clause 6 above, OUTERLINED CONTRACTOR LLC is entitled to (i) forward a letter of demand using a third party demanding full and final payment.
8. Outstanding accounts are subject to default listings on a national credit bureau database. On payment of the outstanding debt the default listing will be adjusted to read “Paid Default” until legislation demands complete removal.
9. OUTERLINED CONTRACTOR LLC reserves the right to provide a national credit bureau with updated personal information.
10. The CUSTOMER also consents that OUTERLINED CONTRACTOR LLC may use a national credit bureau database for tracing, should the CUSTOMER abscond.
11. In the event of any payment not being made on due date, the amount then outstanding shall bear interest as prescribed in terms of the Usury Act with interest calculated daily and compounded monthly from the date of acceptance of the order.
12. In the event of default, all payments shall firstly be appropriated towards interest and costs and thereafter in respect of the capital amount payable in terms of this agreement.
13. The CUSTOMER shall be liable to OUTERLINED CONTRACTOR LLC for all legal expenses incurred by OUTERLINED CONTRACTOR LLC on the attorney-and-own client scale in the event of (a) any default by the CUSTOMER or (b) any litigation in regard to the breach, validity or enforceability of this agreement. The CUSTOMER be liable for all tracing, collection or valuation fees incurred as well as for any costs including stamp duties, for any form of security that OUTERLINED CONTRACTOR LLC may demand.
14. Only electronic fund transfer payments, credit and debit cards, cleared bank checks, cash or deposits will be accepted.
Final Inspection
Prior to making final payment, the CUSTOMER will have the opportunity to review all completed work with the OUTERLINED CONTRACTOR LLC. The CUSTOMER will have the opportunity to identify any incomplete or unsatisfactory work, and is authorized to withhold final payment until such issues are addressed by OUTERLINED CONTRACTOR LLC. The work is considered completed once the invoice is e-signed by COSTUMER.
Warranty
Outerlined Contractor LLC provides a 3-month warranty for new construction workmanship and a 30-day warranty for repairs/modifications to existing workmanship, starting from the project completion date. This warranty covers the work as described in the service agreement but excludes normal workmanship defects, natural imperfections only visible upon close inspection, and natural curing cracks in caulk, grout, and concrete. We are not liable for materials or products provided by the customer or their agents, and manufacturer warranties apply to all supplied materials. Claims must be notified to Outerlined Contractor LLC upon discovery of any issues. Outerlined Contractor LLC will assess and, if covered, repair the issue as per the warranty terms. Repairs or work done by third parties without prior notification and allowing reasonable period to correct work will result in the voiding of this warranty. This warranty is transferable under the service agreement.
Dispute Resolution
The CUSTOMER and OUTERLINED CONTRACTOR LLC, agree to make reasonable efforts to resolve any disagreements related to this contract between themselves. In the event that the two parties cannot agree on an issue, both parties agree to resolve the issue through a civil court. The decision of that court shall be considered final.
Governing Law
This OUTERLINED CONTRACTOR LLC, contract shall be governed by the laws of Florida.
Acceptance
The undersigned parties agree that, after having read and understood the whole of this contract and its annexes, this contract will start from the date it is signed with the full intention of all parties involved to respect and enforce the full terms of this contract times.
